General Conditions Ghent Marathon 2019

You are registered to participate at the event of Golazo Sports (company number BE0442.115.211) with head office Schoebroekstraat 8, 3583 Paal Limburg België, hereafter named Pauwels Consulting Ghent Marathon 2019. Article 1. Registration
The participant declares on the moment of registration to have the age of minimum 18 years old or have the permission of his/her legal guardian to register to this event. The registration is only valid if the registration form has been filled in fully and truthfully, the registration fee has been paid, the payment has been fulfilled for possible additional costs and the general conditions has been approved.

Article 2. Right of withdrawal
The registration falls under the services indicated in Art. VI, 53, 12° Code of Economic Law which excludes the right of withdrawal.
In case of non-participation, nevertheless the reason, you are not entitled to urge a refund of your registration fee and possible additional costs.

Article 3. Cancellation of the event
In case the event can not take place due to exceptional circumstances, Pauwels Consulting Ghent Marathon 2019 will, as far as possible, deliver an equal alternative to its participants as such the possibility to register for free at a new/ next edition of the same event, or another event organised by Pauwels Consulting Ghent Marathon 2019.  Pauwels Consulting Ghent Marathon 2019 will decide at each event which alternatives will be applied in such case. Pauwels Consulting Ghent Marathon 2019 can under no circumstances, held responsible for a refund of registration fee and additional costs (such as merchandising, T-shirts, trainee’s scheme, contribution for charity, …)

Article 4. Participation
Participation to the event can only be fulfilled with a valid registration and by complying to the age requirements below:
  • Walk 9K (kids) (9 km): min. 6 years and max. 12 years old at the moment of participation
  • Walk 9K (adults) (9 km): min. 13 years old at the moment of participation
  • Kidsrun (1,2 km): min. 6 years and max. 12 years old at the moment of participation
  • Juniorrun (2,5 km): min. 6 years and max. 12 years old at the moment of participation
  • 5 km (5 km): min. 6 years old at the moment of participation
  • 10 km (10 km): min. 16 years old at the moment of participation
  • Half Marathon (21,1 km): min. 16 years old at the moment of participation
  • Marathon (42,2 km): min. 18 years old at the moment of participation

Article 5.  Prices
The prices quoted on the website are always in euro and inclusive vat, unless explicitly stated otherwise.

Article 6. Payment
The participant is always obliged to pay the full amount of registration (registration fee and additional costs) in advance, at the moment of registration, and this by using the secure online Payment system on our website. Pauwels Consulting Ghent Marathon 2019 had taken all necessary and relevant precautions to act as a normal and careful online-seller. The organisation cannot be held responsible for any potential theft.

Article 7.  Modification of registration
Participants who want to pass on their registration for the event to another person, can do this online see "My Registration" and this until Sunday, October 6th, 2019 at 23:59u.. Be aware that NO change of any kind can be made on site / on the day of the event. Participants who wish to modify their distance, can NOT do this on-the-spot at the day of the event, but ONLY by using the online module up- or downgrade module and this until Sunday, October 6th, 2019 at 23:59u. at. If due to the new modified distance an extra cost is applied, this will be charged.

Article 8  Healthy & safe
Participation requires a good health. The organisation orders for participation that all participants should perform a preventive sport medical research with a recognised sport-medicine doctor. Upon registration the participant declares to fulfil this condition. The organisation cannot be held responsible for medical problems of the participant.

Article 9. Personal data and intellectual property rights
All information of participants is destined for Pauwels Consulting Ghent Marathon 2019. The information can be passed on to other parties contractually bound to Pauwels Consulting Ghent Marathon 2019, with the approval of the party concerned. The law of 8 December 1992 on the protection of privacy with regard to the processing of personal data, entails right of access to the data and the improvement of the data. In such regard, the participant can at all times, ask for a revision of his/her personal data, using the contact details provided in the general conditions. Through participation at the event, the participant declares to accept the potential use of footage of his/her participation at the event or right to publicity in print, film, video et al. for promotional purposes of the Ghent Marathon and her other events, without due compensation.
The participant agrees to consent to the use of techniques that makes it possible to determine his/her exact location at any time of the event, by capturing signals of the chip attached to his/her chest number as required proof of participation which each participant needs to wear at the moment of the event. The participant gives the permission to Pauwels Consulting Ghent Marathon 2019 that this information will be published to the general public. The participant agrees to Pauwels Consulting Ghent Marathon 2019 the use of live tracking, in such way as described above, as well to record the data in a file, provided to third and published on the internet, social media and possible mobile applications.

Article 10.  Remarks/ Complaints
In case of remarks, these should be submitted through one of the usual channels mentioned on the home page. Pauwels Consulting Ghent Marathon 2019 will at each time treat each remark with due respect and within a period of 10 days after receival of the remark through one of the usual channels. If due to circumstances the period of response can not be fulfilled, this will be communicated to the participant and another alternative time course will be proposed.

Article 11.  Validity Clause
If it appears that one or some articles of the general conditions are found to be void or invalid, for whatever reason, this is without prejudice to the validity of the other parts of the general conditions.
